TheFactual LLC, doing business as Blissley ("Company," "we," "us," or "our") owns and operates the website located at www.blissley.com and any associated mobile applications (collectively, the "Platform"). Your access to and use of the Platform, its content, and any products, services, or applications we provide (collectively, the "Service") are governed by these Terms and Conditions ("Terms" or "Agreement").
PLEASE READ THIS AGREEMENT CAREFULLY. By clicking "I Agree," checking a box, completing a purchase, or continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not create an account or use the Service.
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR CONTACT YOUR PHYSICIAN IMMEDIATELY. THIS SERVICE IS NOT APPROPRIATE FOR ALL MEDICAL CONDITIONS OR EMERGENCIES.
1. Acceptance of Terms
Your use of the Service is subject to this Agreement and all applicable laws and regulations. If you do not agree in full, you are prohibited from using the Service.
We may revise this Agreement at any time at our sole discretion. Changes are effective upon posting to the Platform. Your continued use after posting constitutes acceptance of the revised Agreement. If you disagree with any change, your sole remedy is to stop using the Service.
2. Age Restrictions
The Service is intended for adults only. You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Platform, you affirm that you meet this requirement. Certain products or services may carry additional age restrictions.
3. Nature of Our Service and Your Relationship with Us
Blissley is a technology platform. We connect users with licensed healthcare providers ("Providers"), independent medical groups ("Medical Groups"), and licensed compounding pharmacies ("Pharmacies").
We do not practice medicine. We do not employ Providers, and we do not control or interfere with the independent professional judgment of any Provider. Providers are solely responsible for the clinical care they deliver. We make no representations as to the suitability, reliability, or accuracy of any clinical decisions made by Providers or Medical Groups.
Your use of the Service does not create a provider-patient relationship between you and Blissley. A provider-patient relationship may be formed between you and your assigned Provider through the telehealth consultation process. Providers and Medical Groups may contact you regarding your diagnosis, treatment plan, or prescription. It is your responsibility to monitor and respond to all such communications in a timely manner.
You are establishing a direct commercial relationship with Blissley for use of the Platform and for any non-prescription products or non-medical services offered directly by us. All personal and health information you submit is governed by our Privacy Policy.
4. Telehealth Consent
The Service facilitates telehealth, which involves the delivery of healthcare services through electronic communications. Telehealth is not a substitute for in-person medical care. Before receiving any clinical services, you will be required to review and accept a separate Patient Informed Consent provided by the applicable Medical Group or Provider. Blissley is a third-party beneficiary of that consent.
You represent that you are physically located in the same state as your listed shipping address at the time of your telehealth consultation. The Service is available only in states where we are authorized to offer it.
You are responsible for maintaining the hardware, software, and internet connectivity necessary to use the Service.
5. Prescription Products and Compounding Pharmacy Disclosures
Prescription products available through the Service require a valid prescription issued by a licensed Provider following a telehealth consultation. All prescriptions are fulfilled by independent, state-licensed 503A compounding pharmacies. Blissley does not compound, manufacture, or dispense medication.
Compounded medications are not FDA-approved. The FDA does not evaluate compounded medications for safety, efficacy, or quality. Compounded medications are not generic equivalents of, interchangeable with, or approved substitutes for any FDA-approved product, and may differ in formulation, concentration, and quality. You should not receive a compounded medication if an FDA-approved alternative is clinically appropriate and available to you.
By proceeding with a prescription through the Service, you acknowledge that:
- You have been given the opportunity to ask questions about your treatment.
- Your Provider has exercised independent clinical judgment in issuing any prescription.
- You understand the distinction between compounded and FDA-approved medications.
- You consent to receiving your prescription from the pharmacy selected by Blissley, and you voluntarily waive your right to fill that prescription at a pharmacy of your own choosing.
Prescriptions do not use child-resistant packaging unless you specifically request it. Compounding pharmacy availability may vary by location.
Branded medications such as Ozempic®, Wegovy®, Mounjaro®, and Zepbound® are registered trademarks of Novo Nordisk A/S and Eli Lilly and Company respectively. Blissley is not affiliated with, endorsed by, or sponsored by either company.

Pharmacy assignment is determined by your prescription, your location, and pharmacy licensure. This list is subject to change.
5B. State Coverage
Currently offering services in all 50 states plus Washington D.C. Some services may not be available in all 50 states or Washington D.C. Subject to change.
6. Subscription Products and Billing
Certain products and programs are offered on a subscription basis. By enrolling in a subscription, you authorize Blissley to charge your payment method at the frequency disclosed at checkout.
Billing notice: You will receive advance notice no fewer than 5 days before each recurring charge. This notice will be sent to the email address associated with your account.
Price lock: Your subscription price will not increase due to dose escalation. The price you enroll at is the price you continue to pay, unless you separately elect to change your plan.
Cancellation: You may cancel your subscription at any time through your patient portal account. Cancellations must be completed no fewer than 48 hours before the next scheduled billing date to avoid that charge. Contact support@blissley.com for assistance.
Your subscription charge includes all applicable platform fees, pharmacy costs, and shipping. You will be charged approximately every 30 days.
7. Refund and Cancellation Policy
Prescription products:
- You may request cancellation within 24 hours of placing your order, provided your intake has not yet been reviewed by a Provider.
- Once a Provider has reviewed your intake and issued a prescription, your order cannot be canceled or refunded, as significant pharmacy and clinical resources have been committed.
- If a Provider determines that you are not a candidate for treatment, you will receive a full refund of all amounts paid.
- If your medication has not shipped within 14 days of your order being placed, you are entitled to request a full refund regardless of the status of your review.
- We do not accept returns of prescription medications. Prescription medications cannot be resold or restocked under federal and state health and safety law.
- If you receive the incorrect medication, a damaged product, or a product that does not meet safety standards, contact support@blissley.com within 48 hours of receipt. We will investigate and reship at no cost.
Subscriptions:
- Canceling a subscription prevents future charges but does not entitle you to a refund of charges already processed.
- Exception: If your price increases for any reason other than a plan you elected to change, you are entitled to a full refund of the most recent charge.
Refund requests must be submitted in writing to support@blissley.com within 28 days of the relevant charge.
8. Shipping
Following prescription approval, your medication will be prepared and shipped by the applicable pharmacy. Most patients receive their medication within 3 to 5 business days of shipment. Delivery times may vary due to pharmacy processing volume, carrier conditions, weather, holidays, or other factors outside our control.
Your medication ships in plain, discreet packaging. No identifying information about the contents appears on the outside of the package.
Orders cannot be canceled or modified after a prescription has been approved and the medication has entered pharmacy processing.
If your shipment is lost in transit or arrives damaged, contact support@blissley.com immediately. We will coordinate with the pharmacy and carrier to investigate, and when appropriate will arrange a replacement shipment.
9. SMS and Mobile Messaging
SMS consent is entirely optional. By opting in, you agree to receive marketing, transactional, informational, and care-related text messages from Blissley. Message frequency varies. Message and data rates may apply.
- To opt out: Reply STOP to any message.
- For help: Reply HELP or email support@blissley.com.
Your mobile information is protected by HIPAA and will not be shared with third parties for marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third party.
10. User Accounts and Security
You must register and maintain accurate, current account information. You are responsible for the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@blissley.com if you suspect unauthorized access. You must log out after each session on shared devices.
We use encryption and other technical safeguards to protect your information, but no transmission method is completely secure. We are not liable for security breaches beyond our reasonable control.
11. Acceptable Use
You may use the Service only for lawful, personal purposes. You may not:
- Upload, transmit, or distribute viruses, malware, or harmful code.
- Reverse engineer, decompile, or attempt to extract source code from any part of the Service.
- Impersonate any person or entity.
- Use the Service to harass, stalk, or harm others.
- Submit false or misleading information about your health history.
- Violate any applicable law or regulation.
We reserve the right to terminate or suspend accounts for any violation of these restrictions, without notice, and to cooperate fully with law enforcement.
12. Intellectual Property
All content, trademarks, software, and materials on the Platform are owned by or licensed to Blissley. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal use only. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
13. Third-Party Services
The Service may link to or involve third-party pharmacies, medical groups, providers, and payment processors. These third parties operate independently and are not agents of Blissley. Your interactions with them are governed by their own terms and privacy policies. Blissley disclaims all liability for third-party acts, omissions, or content.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLISSLEY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLISSLEY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM OR (B) U.S. $1,000. ANY CLAIM MUST BE BROUGHT WITHIN ONE YEAR OF THE RELEVANT EVENT.
16. Indemnification
You agree to indemnify, defend, and hold harmless Blissley, TheFactual LLC, our affiliates, Medical Groups, Providers, Pharmacies, and all related parties from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your breach of this Agreement, or your violation of any applicable law.
17. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, arbitration, and governing law survive termination.
18. Binding Arbitration and Class Action Waiver
ANY DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS CONSUMER ARBITRATION RULES, WITH PROCEEDINGS TO TAKE PLACE IN WILMINGTON, DELAWARE. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS-WIDE ARBITRATION, OR CONSOLIDATED PROCEEDING.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or prevent imminent harm.
19. Governing Law
This Agreement is governed by the Federal Arbitration Act and the laws of the State of Delaware, without regard to conflict of laws principles. For any matters not subject to arbitration, you consent to exclusive jurisdiction and venue in the state and federal courts located in Wilmington, Delaware.
20. Entire Agreement and Severability
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Blissley with respect to the Service. If any provision is found unenforceable, the remaining provisions remain in full force.
